Two pharmaceutical companies reach settlement in price-fixing case – InForum

BISMARCK – Consumers who purchased certain generic prescription drugs in the United States between January 1, 2010 and December 31, 2018 may be eligible for cash under two major settlements.

According to a statement from North Dakota Attorney General Drew Wrigley, settlements and cooperative agreements have been reached with Heritage Pharmaceuticals and Apotex after both companies engaged in widespread, long-running conspiracies to artificially inflate and manipulate prices, and unreasonably restrict trade for countless companies. generic prescription drugs.

The $10 million settlement with Heritage Pharmaceuticals was filed on October 31 in the United States District Court for the District of Connecticut. A settlement with Apotex for $39.1 million is subject to obtaining signatures from all states and territories and will be finalized and filed soon, Wrigley’s statement said.

The settlements are the first two settlement and cooperation agreements with industry defendants in the ongoing generic drug price-fixing lawsuit involving more than 195 generic drugs. Both companies are cooperating in ongoing lawsuits against 30 corporate defendants and 25 individual executives. The two companies also agreed to a series of internal reforms to ensure fair competition and antitrust compliance.
